The Supreme Court on Wednesday stayed a Delhi High Court order allowing Rajeev Saxena, an accused-turned-approver in the AgustaWestland chopper case, to go abroad for medical treatment.
The apex court also issued notice to Rajeev Saxena, and sought his detailed response after hearing from the lawyer of the Enforcement Directorate (ED), which submitted to the SC that there were certain new facts surfaced on violations of I-T & Black money laws by the accused, Rajeev Saxena.
The top court vacation bench, headed by Justice Sanjiv Khanna, also directed that Rajeev Saxena may be examined by a medical board to be set by the AIIMS director here to ascertain his ailments.
“We issue notice to the Respondent – Rajeev Saxena, on hearing the appeal filed by the ED, the prosecuting agency in the matter. He has to file a detailed response in the ED’s charges,” the bench of the top court said, after hearing a detailed arguments and submissions from the ED and Rajeev Saxena.
Rajeev Saxena, who is diagnosied with cancer and the Delhi High court had earlier in its order directed him to travel abroad to get better treatment for his ailments.
The ED then moved the SC by filing an appeal challenging the Delhi High court order.
Rajeev Saxena is an accused in the AgustaWestland copper scam case and he was made an approver by the ED subsequently during the investigation in the matter.
