Tripura HC serves notice to state over 10,323 terminated teachers

The High Court of Tripura issued a notice to Tripura government and sought reply within four weeks regarding the double stand of the state government for termination of the service of under-qualified teachers. In a petition filed by one Sajal Deb belongs to 10,323 teachers whose job was terminated in May 2014 and argued that the employment policy of the Left Front government was grounded in case of the teachers but the employees of other departments whose job was given in the same policy have not been affected.

The petitioner claimed that in the main judgment of the high court, which terminated the job of 10,323 teachers neither mentioned the total number nor mentioned the name of the employees whose job would be terminated. The judgment was clearly hit the employment policy of the government but when the state government issued termination order and subsequently issued ad-hoc appointment made only the teachers who had been appointed during a particular period.

Similarly, in 2012 without prescribed qualification and norms of Right to Education Act 996 science teachers were appointed by the state government following the same policy but the job of those teachers were also secured by the state. Moreover, the state government later had facilitated them to acquire BEd and D El Ed. Since, the high court void the employment policy of Tripura government, job whichever given all were supposed to be cancelled but it was not.

In another case, a group of science teacher had appointed in 2010 had been terminated and absorbed on ad-hoc basis till next March but the teachers appointed in 2012 with same qualification and process was kept secured by the state government, which the petitioner believed discrimination in offering equal opportunity.

In the third case, a group of teachers had appointed in 2010 but not being the part of the main case anyway was also terminated after the judgment. They also argued despite having ambiguity in the judgment the government undertook partial stand and made only 10,323 teachers victim illogically. 

After hearing the petitions High Court division bench comprising of Chief Justice Sanjay Karol and Justice Arindam Lodh have sought the view of the state government and subsequent clarifications. However, the state government sources said that the order was executed by the then Left Front government and BJP-IPFT government sought only two years extension of the ad-hoc teachers to run the schools, as there has been a huge shortage of teachers.
