‘Manushi’ founder Madhu Kishwar moves SC seeking stay on Justice Gogoi’s nomination

Echoing the voice of many and the opposition in particular, Madhu Kishwar, head and founder of Manushi, a human rights body, has moved the Supreme Court through a PIL challenging the nomination of former CJI Ranjan Gogoi as the member of the Upper House. In her petition Kishwar has minced no words to say that, she feels aggrieved at such a decision to pick Justice Gogoi as Rajya Sabha MO which, she underwrote, “ it compromises the independence and credibility  of the country’s judiciary.

Kishwar further emphacised that during his tenure as the CJI, Justice Gogoi had delivered ‘several historic’ judgements but some of which had led to stoking sentiments and widespread unrest.

She has prayed the apex court to stay the notification.

She has contended that the judiciary enjoys the faith of the people who hold it in highest esteem and any such action, as in the case of Justice Gogoi, as the Rajya Sabha MP, can be seen as ‘ assault on the independence of the judiciary’.
